United States Supreme Court Case - Oklahoma Statewide Charter School Board v. Drummond - June 2025 Update
It was a privilege to be present when the Oklahoma Statewide Charter School Board v. Drummond case was argued before the United States Supreme Court. We were disappointed the case ended up in a 4-4 tie (Justice Amy Coney Barrett recused). Due to the tie, the decision against the Board by the Oklahoma Supreme Court controls.
Oklahoma parents and children are better off with more educational choices. While the Supreme Court’s order is disappointing for educational freedom, the decision does not set precedent, so the Court can revisit this issue in the future. The U.S. Supreme Court has been clear that when the government creates programs and invites groups to participate, it cannot single out religious groups for exclusion. The work to protect this vital freedom for parents and students will continue.
It was an honor to represent the courageous Board.
